OK folks, time to wake up and smell the coffee (and I can say that because I am finally out of bed, sitting in a café, eating soup and drinking… wait for it… coffee!).

Seriously though, things are getting out of hand in this country.  Fresh off the road from the Sturgis run, I am just getting over the hard time we all had trying to find a good place to eat and drink without being hassled about our colors.  “Sir, I am sorry, we have a no-color policy here… but you can turn your vest inside out if you want to.”

“Yeah… that’s not gonna happen,” were the words that came out of my Enforcer’s mouth.  I added, “you might as well ask us to hang them upside down on the wall while you are at it.”

We left.

Anyway, now I am back in Texas and settling back into routine when… There we were, just minding our own business…  Going to a benefit for a fallen biker who left his family in a jam (more like the BS insurance companies left them in a jam), when all of the sudden a cop crosses three lanes of traffic while we are in a pack eight deep making a u-turn under an overpass.  He points to the only prospect in the group and tells him to pull over.

I slow down, designate a rider to stay close (one with a squeaky clean history, title, registration, insurance, inspection, quiet pipes, low bars, and everything else), and I lead the rest to the next parking lot where we dismount and wait to see what is up.  At this point we are interested in keeping our prospect out of trouble while not putting the rest of the club in a position where a pissed-off peace officer might start digging to try to find something wrong with everyone else in the group.

About five minutes pass before our prospect and his chaperone come rolling down the street and pull into the parking lot.  Luckily, I suppose, the only thing the cop got him for was loud pipes.  Well, the cop wrote “excessive noise by use of a loud engine” on the ticket, which could mean a number of things… but it was the pipes that got him nailed.

Which is totally BS anyway because, his pipes are not excessively loud and may not even be the loudest pipes in the group.  He was just an easy target who was going under an overpass that amplifies and reflects sound and the cop had a wild hair and had to pull someone over.  In fact, the cop acknowledged that he had a daughter who was “distracted” by a motorcycle and it “caused her to get into an accident.”  So he was looking for someone to bust.

Whatever.

Anyway, on to the real issue here which is noise ordinance laws and rider responsibility.  I personally feel that loud pipes DO save lives.  You may want to look into the statistics of how many riders are killed because they were rear-ended.  No, the noise of pipes may do nothing for oncoming traffic, but it can be a clear indication to that crazy soccer mom on the phone in the mini-van that is riding up your ass from behind!

And with that being said, I also think it is our responsibility to not be a-holes about the whole thing… really loud, ear splitting exhausts gunned in quiet neighborhoods or in the middle of the night… or even when people are just standing too close can be a really rude thing.  I mean, my Panhead is pretty damn loud, but if I don’t gun it in the neighborhood, kick start it in my closed garage at night to muffle the noise, and coast on through to the main drag in a mild mannered fashion, I don’t see a problem with it.

OK- done with the soapbox portion of our show and on to the meat.  You see; there are a number of cities in this fine land of ours that are working to silence loud exhaust pipes.  Not loud car stereos, not jackhammers and noisy construction, not the jets that fly 3 feet from my freakin’ roof at 9:30pm when my two little girls have finally fallen asleep, not the neighbor’s gas powered lawn mower, trimmer, and blower that he just LOVES to use at about 7am on a Saturday, not incessant car alarms that don’t do a bit of good anyway except to make you hope someone steals the damn thing and shuts it up.  No, none of this is an issue… what is the real burden on society’s fragile eardrums are loud motorcycle pipes.  Makes sense right?  I mean, according to the US Department of Census, motorcycles make up approximately .12% of the vehicles on our roads!  What, and with at least 80% of those falling at or under any noise ordinance level, we are looking at a HUGE number of bikes simply destroying the quality of life for the average citizen.  Sheesh.

Regardless of the above rant, you have cities like Boston, New York, Daytona, Myrtle Beach, and others trying to silence the droves of bikes on their streets.  And now California is looking at a statewide bill to strike down loud pipes.  SB 435, known as the “motorcycle exhaust bill,” which would require stock exhaust on all model year 2013 and newer motorcycles, HAS PASSED and is currently sitting on the Governator’s desk waiting to be signed into law.  There is a link at the bottom of this post to contact the governor and tell him you DO NOT WANT SB 435 signed into law!

In a related vein of thought, Edmonton, Alberta, claims to be the first Canadian city to officially start fining motorcycles for excessive noise levels that exceed 92 decibels while idling or 96 decibels while the engine is revving to benchmarks of 2000 and 5000 rpm.  The city council passed the new bylaw amendment that took effect on July 1st; the fine was set at $250.

During the demonstration prior to July 1st, police tested in excess of 100 bikes and found about 15 percent of the motorcycles failed by using a sound meter that was placed 20 inches from the exhaust.  15 percent!!

Reports go on to say that police officer’s are “fine tuning” their hearing to be able to distinguish the illegal pipes as they travel down the road.

So, there you have it… no colors, helmets required, only short ape hangers, and now no loud pipes!  Do what you can to fight the good fight and be sure to let us know if there are issues in your area that need to be addressed.

Last year, on my way home from the Horse Smoke Out X, I hit the Dragon and had a really nice ride.  About four months ago there was a rock slide and the dragon became impassable.  But now she is back and ready to eat your bike!  Here is the story:

The Dragon, a section of U.S. Highway 129 offering more than 300 curves, will beckon this weekend to its international fan club of motorcyclists.

After being closed for nearly four months because of a massive rockslide, The Dragon should be accessible from the Tennessee side this weekend.

Weather permitting; authorities expect the roadway to be opened to traffic today, according to the Tennessee Department of Transportation. That would be three weeks ahead of the scheduled reopening date of July 31.

The rockslide occurred March 14 near Chilhowee Dam in Blount County. Two weeks later, TDOT awarded a $1.99 million contract to Pacific Blasting and Demolition Ltd. to clear and stabilize the slope.

The contract offered daily incentives of $6,500 for each day the contractor reopened the roadway before the July 31 deadline. If the contractor opens the road today, the company will collect a bonus of $136,500, according to TDOT.

Workers have blasted loose rock from the slope and installed more than 7,000 feet of metal bolts that were grouted into the mountainside to stabilize the area. The contract also called for installing wire mesh on the slopes to reduce instances of rock falling onto the roadway.

Workers are finishing the job by installing guardrails, paving and striping the road. TDOT regional spokeswoman Yvette Martinez said workers are installing about 100 feet of guardrail and repaving about 1,200 feet of roadway.

During the work, more than 600 truckloads of dislodged rock were hauled a mile away to a waste pit. That displaced rock weighed more than 14,000 tons, officials said.

Motorcycle enthusiasts from around the world come to test their skills against the curvy road, boosting the area’s economy with their visits. But the portion of the road deemed The Dragon because of its curves has remained accessible only from the North Carolina side and riders were restricted to using the route from 8 a.m.-8 p.m. as the cleanup and stabilization work continued.

Rogue of www.bikerrogue.com just sent me a note asking if I was following the SB 435 in California.  Well, no, I had not been, but I looked it up and it is the same kind of thing that I have been reading about in NYC and the New England area (past write ups here 1, 2, 3, 4).

The long and the short of it is that we need to keep an eye out for what our government is up to.

An act to amend Section 44011 of, and to add Section 44012.5 to, the Health and Safety Code, relating to air pollution.

SB 435, as introduced, Pavley. Smog check program: motorcycles. Existing law establishes a motor vehicle inspection and maintenance program (smog check), administered by the Department of Consumer Affairs, that provides for the inspection of motor vehicles upon registration, biennially upon renewal of registration, upon transfer of ownership, and in certain other circumstances. Existing law exempts from biennial inspection all motorcycles until the department implements test procedures applicable to motorcycles. Violations of smog check

requirements are a crime. This bill would require the department to include model-year 2011 and newer motorcycles in the smog check program beginning January 1, 2012.

Because violations of smog checks for motorcycles would be a crime, this bill would impose a state-mandated local program.

(2) The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.

This bill would provide that no reimbursement is required by this act for a specified reason.

Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program:            yes.

Never thought I would be making this statement:  ABATE acted like AMA; AMA acted like B.O.L.T.  I know we all have different opinions of AMA, for me, a member since the 80’s; they (AMA) never really seemed to take on  bikers rights, at least in my little arena of dealing with them.  This afternoon the AMA rep spoke with conviction and determination with all of the facts and AGAINST SB435…he got a loud spontaneous applause.

Pavely opened up thanking ABATE; the Transportation chair commented that ABATE was formerly opposed and in now neutral to 435.  Pavely also closed thanking ABATE.  Jim Lombardo was pathetic.  You could hear a lot of mumblings…fuck ABATE.  I would guess that ABATE being neutral carried a lot of weight with the committee

Jim Palowoda (sp) is the spoke person for the HD Dealers Association; he spoke against 435 and did okay.  One guy for SB435 stated motorcycles pollute 190 times more than a car based on per mile driven.  The committee ask John if that was correct; he said motorcycle do pollute more than a car; but cars are driven far more than motorcycles and motorcycles get 50 to 60 miles per gallon (I better get my Harley in for a tune up).  So based on gas mileage and miles driven; motorcycles are far less polluting

Pavely made the statement that a lot of her friends ride motorcycles and they told her only a small percentage of people (nasty ole one percenters) ride with loud pipes.  So her law would only affect a few bikers.

The spokesperson for the highway patrol was there.  Their stance is neutral.  The guy did a pretty good job; trying to explain to them that the law is unenforceable due to lack of training of decibel meters…but none heard that.

It was a strong turn out.  The assembly room was full; the upstairs was full.  People were in the hallways; others went to the cafeteria and watched on TV, others waited outside the Capitol

What got me about the whole day; other bills are being presented and people are talking vehicle codes…no one on the transportation committee has a copy of the vehicle.  They don’t know if they are getting  lied to or being told the truth…it’s all about what sounds good; screw if it is legal.

CHP stated that CA law allows up to 95 decibel while Federal is 80…Mark and I couldn’t find that law…but it is early yet.  I wasn’t able to get back in on the first floor…so unable to speak my objections…but there were plenty others who did.

Strong turn out by the biker community; great job by the AMA; ABATE was embarrassing; John (Dealers rep) did okay.  Probably will pass the committee; but we can still fight.

Brothers and Sisters,

As I announced a few days ago, our friend Sputnik, founder and state chair of the Texas Motorcycle Rights Association, passed away last week. Please remember his wife, Gwen, their family, friends and the biker community in prayer in the loss of this man who served bikers tirelessly in the fight for our rights and freedoms.  Sputnik had, over the years, developed personal access to the most influential people in the capitol, with the ability to garner meetings with the Lt. Governor, Speaker and committee chairs that were frequently the envy of his allies. At the same time, though he knew how to play the insider game consummately.  Most importantly, his base was large and well-organized, as demonstrated by Biker Day at the Lege when riders converge on Austin from all over the state for a lobby day preceding an annual weekend of partying.

Many of you know Sputnik.  Even more of you know who he is and what he has done for the biker community.  I had the pleasure of meeting him for the first time in 2005 or so at a Popular Culture/American Culture Convention.  I was speaking about my biker related fine art work and he was speaking about biker’s rights.  He was good at that… it was what he did and who he was.

Shortly after I became more involved with the Texas Confederation of Clubs and Independents in the Houston area.  Sputnik would show up at each meeting to give us the run down on what was going on in the world of biker rights.  At each meeting, I would take a short bit of time to say hello, ask how he was, and simply show respect.  He certainly had earned it.

Unfortunately, Sputnik passed away early this week and, while the news has been out since it happened, I am just now getting it into the blog.  For those that did not know, what follows is the e-mail that I, among many others, received Thursday morning.
