The off-duty police officer accused of forcing a teacher into an alley and raping her at gunpoint fears the Manhattan District Attorney’s office will pursue his case with a vengeance because two police officers were acquitted of rape in a high-profile case this spring.

Michael Pena, 27, is being held at Rikers on $1 million bond after he allegedly grabbed the 25-year-old woman off the street and assaulted her as she walked to work Friday in Manhattan.

“The DA is arresting cops, indicting cops,” Pena told the Daily News in his first jailhouse interview. “They’re trying to make an example out of me.”

Pena did not comment specifically on the charges against him, telling the paper his lawyer advised him not to discuss the case.

He was arraigned Saturday on charges of first-degree rape, forcible rape and predatory sexual assault.

Police said Pena, who was intoxicated, approached the woman as she was walking near Park Terrace West in Inwood and asked for directions to the No. 1 train.

He then showed her his gun in his waistband, put his arm around her, saying “you are coming with me,”  and took her to an alley, police said.

In their courtroom account of the alleged rape, prosecutors said Pena ushered the woman behind a building on Park Terrace West. A resident inside the building told police she looked out the window and saw the defendant violating the woman. The resident called 911.

After two 911 calls, police arrived to find Pena with his pants still down.

Pena told the News he had a “picture perfect” record and had never been in trouble before this incident.

His lawyer, Juan Campos, portrayed him in court as a family man who recently moved in with his fiancee. Campos suggested that if the rape allegations are true, “they could be the product of something that can’t be explained.”

Though Pena would not speak specifically about the incident, he told the News, “Eventually the truth will come out. Everything’s not black and white. There are shades of gray.”

The May rape acquittal of former police officers Kenneth Moreno and Franklin Mata, who were sentenced this month to a year and two months, respectively, in prison for official misconduct, marked a big loss for the district attorney’s office.

Compounding that loss, the district attorney’s office may drop sexual assault charges against former International Monetary Fund head Dominique Strauss-Kahn this week.

56Three wheels are set to lead the pack of the inauguration parade on January 20th.  It is customary to have the parade let by motorcycles riding in the “V” pattern, and this year the sidecar rigs are going to be let by a custom Police Model Tri-Glide. Lieutenant Scott Fear, Commander of the U.S. Park Police Motorcycle Unit, will lead the parade from the Capitol to the White House.

87a2Along with 50 other motorcycles, The District of Columbia Metropolitan Police Department received delivery of twelve new FLHTP Electra Glides to follow up the Tri-Glide.  And these are special models too.  For the fifth year in a row, Harley Davidson of Frederick is providing the custom Harleys with sidecars for the parade.  This is a big deal to the dealer as bids must be put in every four years for the honor of supplying the bikes.  The Frederick shop is rated as #1 in the country for service and I suspect this has a lot to do with them getting the contract.

Regardless of how you feel about the upcoming presidency, check out the parade just to see the bikes.  It should be a beautiful sight.

Myrtle Beach Update

Well, the rally has ended and there are some really interesting results from this year’s Myrtle Beach Fall event. 

First and foremost, a lot of riders skirted the city limits of Myrtle Beach all together.  Attendence in town was certainly down, vendors were down, and a lot of local businesses lost the biker’s dollars.  I believe this had as much, if not more to do with the 15 new laws to curb the bikers vacation as it did the economy and gas prices.

Within the city limits, there were only three tickets issued for sound violations.  It seems the cops were giving the bikers a bit of a grace period and issuing a lot of warnings, but not handing out violations.  It has also been reported by the Myrtle Beach Police Department that there were a total of 17 complaints about sound.  This statistic does not tell us whether the complaints were about bikes, cars, trucks, music, or other possible sound nuisances. 

A break down in the numbers from the Mrytle Beach PD reads as follows:

37,125    in overtime pay for police officers

1537       calls for service

368         citations and/or charges

227         people arrested

6             DUIs

26           collisions

1             death

3             stolen motorcycles

Speaking of stolen motorcycles, there was a bust of a chop shop in nearby Andrews.  The three men arrested included Martin Grice, a jailer at the Georgetown County Jail, and Patrick Cumbee, an Andrew’s Police Officer.  The third man, Dedrick McCray, must have been the misfit of the bunch as he wasn’t involved in law enforcement at all.

All in all, the rally commenced and those that attended had a good time.  It is our hope that the MB City Council relaxes a bit and lets the bikers come for a good time.  You and I know that although we all love a good party, we are a good bunch, right?

As of now, there are three lawsuits against the city in an attempt to prove the new laws unconstitutional.
